CAMPFINDERS.COM provides this page as a statement of the terms and conditions under which you use this web site and the Camp Finders service. Read this page and the statement carefully. Do not use this web site and service if you are unwilling or unable to abide by this statement. By using this web site and the Camp Finder's service, you agree to abide by the provision set out here. CAMPFINDERS.COM is a web site own by Camp Finders, Inc., which is identified on this page as the "Company".

Prohibited uses

The web site and the service provided by Camp Finders currently offers individuals the opportunity to identify summer camps or related summer activities that may be suitable for children or young adults. The Company specifically prohibits any use of the web site and/or the services of Camp Finders, and you agree not to use the site and/or the services for any unlawful activity, the dissemination of false, misleading, or inaccurate information about you or another person or entity. If you have been given a password which allows you to access a non-public area of this site, disclosing to or sharing your password with any third parties or using your password for any unauthorized purpose.

User Information

Camp Finders, Inc. was established and currently operates primarily to assist parents and their children in identifying interesting and suitable summer camps or related summer activities (teen programs) geared towards the needs of a particular child and the desires of that child's parents. Camp Finders, based on actual discussions with the parents and child involved, seeks to make particular recommendations for summer camp or summer activity placement. Some children and their parents are more interested in and suited to a "sports" camp environment while others may be more interested in pursuing other forms of activities. Camp Finders seeks to tailor its recommendations based on discussions with you and your family and discussions with the owners and operators of he camps and programs, and visits made to the camps, and an understanding of the programs being offered. That process necessarily involves a discussion of personal information about the child and camps involved. While the web site and the service seek limited information, ultimately you will be asked to provide the Company with certain personal information. In addition to the terms and conditions that may be set forth in any Company privacy policy, you understand and agree that the Company may disclose to third parties, on an anonymous basis, certain aggregate information contained in the information supplied to Camp Finders. Except to the extent necessary to aid in the placement of the child and to place you in touch with particular camps or activities, the Company will not disclose to any third party your name, address, e-mail address or telephone number without your prior consent, except to the extent necessary or appropriate to comply with applicable laws or in legal proceedings where such information is relevant. The Company reserves the right to offer third party services and products to you based on the preferences that you identify in your contacts with Camp Finders and at any time thereafter; such offers may be made by the Company or by third parties. The Submission of Information By Users

As a user, you are responsible for your own communications with the camps and /or programs and are responsible for the consequences of that communication. The Company makes no representation, guarantee, or warranty regarding the truthfulness, accuracy, or reliability any communications made to or by the camps, programs, families and children. The Company also does not endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk.

As noted above, the company will seek a variety of information that may be useful to potential camps and related activities. However, the web site and service acts simply as a means to facilitate contact by you with the camps or programs and has no obligation, and assumes no obligation to screen communications or information supplied to or by users in advance and is not responsible for screening or monitoring material provided by users or the camps after the initial contact. While we do review camps and interview the operators of camps and various summer programs, as well as families and children, neither the web site nor the Company screens or censors the camps or programs offered. The Company is not involved in the actual transaction between camps and the families. As a result, the Company has no control over the quality, safety or legality of the camps or activities, the truth or accuracy of the listings, the ability of camp or the activity to provide the stated experience. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the web site and/or the service.

If notified of communications or conduct which allegedly do not conform to these Terms and Conditions, the Company may investigate the allegation and determine in good faith and in its sole discretion whether to cease contact and/or dealings with those involved. The Company has no liability or responsibility to users for performance or nonperformance of such activities. The Company reserves the right to prevent their further access to the web site for violating the Terms and Conditions or the law. The Company may take any action with respect to user-submitted information that it deems necessary or appropriate in its sole discretion if it believes it may create liability for the Company or may cause the Company to lose (in whole or in part) the services of its ISP other suppliers.

Because authentication of those using the services provided by Camp Finders on the Internet or otherwise is difficult, CAMPFINDERS.COM cannot and does not confirm that each user is who they claim to be. Because we do not and cannot be involved in user-to-user dealings or control the behavior of participants on CAMPFINDERS.COM, in the event that you have a dispute with a camp or program, you release the Company (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code d1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known to him must have materially affected his settlement with the debtor." We are under no legal obligation to, and generally do not control the information provided by users or camps which is made available.. By its very nature, other people s information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. We expect that you will use caution and common sense when using this web site. Changes are periodically made to the web site and may be made at any time.

You acknowledge and agree that you are solely responsible for the form, content and accuracy of any information provided to Camp Finders and/or the camps or programs with whom you may deal.

The Company is not to be considered to be a provider of services with respect to your use of the web site and the Company shall not be responsible for any decisions, for whatever reason made, or made by any camp or program with whom you may deal.

THE COMPANY DOES NOT WARRANT THAT THE WEB SITE WILL OPERATE ERROR- FREE OR THAT THE WEB SITE AND ITS SERVER ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF THE WEB SITE OR THE INFORMATION ON THE SITE RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR THE WEB SITE AND INFORMATION ON THE SITE ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. LIMITATION OF LIABILITY

The aggregate liability for the Company to you for all claims arising from the use of the information on the site is limited to $100.

TERMINATION

The Company reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to refusing to process your request for assistance, deletion of your program or camp from the list of camps and programs used by Camp Finders and the immediate termination of your registration with or ability to access the web site and/or any other service provided to you by the Company, upon any breach by you of these Terms and Conditions.

INDEMNITY

You agree to defend, indemnify ,and hold harmless the Company, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the information on the site or your breach of the terms of these Terms and Conditions. The Company shall provide notice to you promptly of any such claim suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.

GENERAL

The Company makes no claims that the information on the site may be lawfully viewed or downloaded outside of the United States. Access to the information on the site may not be legal by certain persons or in certain countries. If you access the web site from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms and conditions are governed by the internal substantive laws of the State of Florida without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Palm Beach County, Florida.
